Visa Transfer (J-1 to H1-B) Program Details

If you are currently a J-1 Cultural Exchange Teacher in the US, and wish to continue your teaching career in the US , it is urgent that you read the information below.

We know that your teaching career in the United States is an urgent and vital concern. Teachers Council will assist you . TC has assisted many teachers and their families with the transfer their J-1 visa to H-1B visa.

It is extremely important that you act immediately, because schools are now recruiting for the new academic year.

It is now possible that you can obtain your H-1B visa and begin the orientation and professional development programs that schools require before the academic year begins in late August or September.

Important requirements:

1. If you have a contract with a school to teach, you must honor your contract and complete your teaching term.

2. You must honor all commitments that you have made with your sponsor and the Bureau of Cultural Affairs. TC will assist you.

3. If you have a J-1 visa, you are required to return to your home country if required by your sponsor. TC will assist you to obtain your H-1B and comply with the policies and requirements of your sponsor and the Bureau of Cultural Affairs.

4. You will need to obtain a Waiver, unless your visa is stamped:

A. Your J-1 visa must be stamped: "BEARER IS NOT SUBJECT TO SECTION 212(E). TWO YEAR RULE DOES NOT APPLY.

B. If your J-1 Visa is stamped." BEAR IS SUBJECT TO INA 212 (E). TWO YEAR RULE DOES APPLY.

5. If you do not have a Waiver to INA 212 (e), you should apply for the waiver . However, you also must comply with the policies and requirements of your sponsor and the Bureau of Cultural Affairs.

You must obtain I-797, Notice of Action, Approval Notice. An example of a waiver is provided below:

"The United States Information Agency, based upon a "No Objection" statement from the government of your nationality, has recommended that you and any members of your immediate family be granted a waiver of the two year foreign residence requirements of Section 212(e) of the Immigration and Nationality Act, as amended. This recommendation only refers to the two-year foreign residence obligation which was incurred by virtue of your current or prior non immigrant status as a J-1 Exchange Alien. "Accordingly, upon consideration of the evidence of record, and on the basis of the favorable recommendation of the United States Information Agency, you and any members of your immediate family who have become subject to the two- year foreign residence requirement solely based on their relationship to you, are here by granted a waiver of the two year foreign residence requirement of Section 212(e) of the Act."

In addition to the requirements stated above, you will need to do the following:

1. Please complete the TC application form with information about your visa status. Complete information about your educational background, the subjects you are teaching, and information about your US teaching license, if applicable.

2. Complete the agreement provided by TC that explains costs and requirements. [TC will provide you with an agreement.].

3. Provide the following documents to TC: Please scan and email or send a copy of your passport, license, transcript, diploma, evaluation [if available], letter of intent or job offer [if available].

Also, immigration legal staff or their paralegals will be coming to North Carolina, South Carolina and other States in the near future and can arrange to meet you.
