H-1B Extend or Visa Transfer

EXTENSION

  • If you currently have an H-1B and the visa term expires within six months, you must make application for extension. Teachers Council will provide complete assistance.
  • While applying your H1B extension, also a separate application is required for the H4 extension(s) for your dependents. Your dependents will NOT automatically obtain an extension based on your H1B extension.

TRANSFER

Changing from one visa to another is called a “transfer”. Transfers are possible if you have a B-1 visitor visa, F-1 student visa, H-4 dependent visa. Other visas may be applicable.

To transfer from your current visa to ah H-1B visa, requirements include:

  • H-1B Sponsor
  • Supporting Documents:
  • Current Valid Visa
  • Transcript Evaluation
  • Copy of your educational certificates,
  • Passport

You can start working for your new employer ONLY after your H1B approval.

If your application for an extension or transfer is approved, you will be issued a replacement I-94 with a new expiration date. You can be in the USA without having your passport stamped until your I-94 expiration date. Stamping is NOT necessary even if the VISA on your passport expired. (You are in legal status as long as your I-94 is valid)

If you wish to have your visa stamped, you should travel abroad and visit the US embassy to have an interview.
